CRP terms: The Quail Buffer CRP expires in September 2027 (1.59 acres:. New owners cannot farm the 1.59 acres before then—doing so requires USDA repayment of past payments for the new owners. If tracts 1 and 2 have separate buyers, the USDA will split the area accordingly for future payments.
Farming Rights: The existing farm tenant is relinquishing their farming rights, having applied variable rate potash and completed fall tillage. The new owner will need to reimburse the farm tenant $45 per tillable acre. If buyers wish to keep the previous farm tenant, they should contact the auction company for further contact information.
Rights: All of the Seller’s mineral, oil, and gas rights, if any, will transfer without warranty of title or title evidence.
Bidding Method: Bids are per acre; final price is the high bid times total acres for each tract. The purchase agreement will state the total tract price, which remains fixed regardless of future surveys.
Bidding Increments: $25.00 per acre.
Extended Bidding: Any bid placed on Tracts 1-2 within the final 2 minutes will extend bidding on both Tracts 1 and 2 by 2 minutes.
Down Payment & Closing: 10% of the total purchase price is due on auction day. The remaining balance is due at closing, approximately 40 days following the auction. Down payment is held in escrow with the title company.
Purchase Agreement: Successful bidders must sign agreements on Tuesday, April 1 in person or via DocuSign.
Crops & Possession: New owners gain possession at closing.
